Orders

All orders are subject to acceptance and product availability. Modern Art Oxford aims to ensure that the pricing of products on the web pages is correct at all times, however, the web pages may not accurately reflect the correct details at the moment at which you place your order. Modern Art Oxford cannot confirm the price of a product until your order is accepted on dispatch and reserves the right to change prices without prior notice.

Availability

Availability information is listed on each individual product. If Modern Art Oxford has insufficient stock to deliver the goods you have ordered, Modern Art Oxford will inform you by email at the address given in your order form and any sum, which may have been debited from your credit card, will be credited to you within 30 days of the date of your order. Prices of some goods may differ from those in the physical shop.

Pricing and currency

The total cost of your order reflects the price of the items ordered plus a shipping and handling charge for packaging and postage. You will be contacted to confirm the status of your order. All products are priced in pounds sterling (£) but there is an approximate currency converter for US Dollars, Euros and Japanese Yen. Prices include UK Value Added Tax where applicable.

Validity

By ordering a product you accept Modern Art Oxford’s terms and conditions, which can be subject to change at any time, and it is your responsibility to check them regularly before ordering products in case there are any changes.

Acknowledgement of order

When you have completed your order, you will be sent a confirmation email. It will state what the products are, the cost (including postage, packaging and VAT if applicable), delivery information and invoice details. If your order has been unsuccessful you will be made aware of the reason why and possible explanations.

Payment

Modern Art Oxford accepts all major credit and debit cards. Payment can also be made over the telephone +44 (0)1865 722733. All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and Modern Art Oxford will not be liable for any delay or non-delivery.

Our contract

A legally binding contract between you and Modern Art Oxford will be formed upon confirmation receipt of the dispatch of your order. This email confirmation shall represent Modern Art Oxford’s legal acceptance of the offer you made to purchase the product(s) when you completed your order. If Modern Art Oxford confirms to you that some but not other products that you have ordered have been dispatched, the product(s) that have not been dispatched will not form part of the contract. In the event of any change, for example, in price or expected delivery date between completion of your order and contract formation, Modern Art Oxford shall inform you and you shall at that point have the right to either (i) accept such change (in which case your email reply will represent a new offer which Modern Art Oxford will accept upon notification of dispatch) or (ii) reject such change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).

Safe Shopping

Modern Art Oxford does not store any credit card details. All transactions are processed by Protx, which uses bank approved software and the highest level of encryption to ensure that your credit card details are kept secure at all times. The Protx certificate may be viewed by clicking on the padlock at the bottom of the payment pages.

Delivery

All deliveries are made by Royal Mail or courier service depending on the shipment and delivery address. All items are usually dispatched within 5 working days after an order has been placed. Modern Art Oxford aims to deliver within 3-5 working days for UK orders, within 7-14 days for European destinations and within 12-24 days for the rest of the world.

Shipping charges are calculated from your shipping address, and the weight and dimensions of the package to be delivered.

Cancellations

Orders are executed within 5 days so cancellations are possible if you get in touch immediately. If you do find you have made a mistake please contact us immediately so that we can try to intercept your order.  In the event that you should decide to cancel an order, please contact us as soon as possible, quoting your name and order reference number.

 

Returns Policy

If, for any reason you are not entirely satisfied with your order, Modern Art Oxford will refund the value of the goods supplied. Your statutory rights as a consumer are not affected if you wish to make a return. Modern Art Oxford will repay you the value of the goods, excluding delivery costs, within 30 days of receipt of the returned goods as long as they are received in the condition in which they were dispatched. This will be without any further charge to you except the direct cost of returning the goods. Please appropriately package the items with the letter of authorisation and the original invoice and send it to Modern Art Oxford. For the return of high value goods, Modern Art Oxford recommends that you use a recorded delivery.

Damaged goods or incorrect deliveries

The purchased goods must be stored by you in appropriate conditions. If you do not store them in appropriate conditions, Modern Art Oxford cannot be held responsible for faults or problems that arise as a result. Any claim by you in respect of any shortages and/or defects in the goods must be notified to Modern Art Oxford by you within 7 days of the delivery date, stating the nature of the shortage/defect and quoting the invoice number. Failure to notify Modern Art Oxford will deem you to have accepted the goods.

In addition for defective goods, Modern Art Oxford will refund you reasonable costs incurred for postage of the goods, but shall have no further liability to you. If you do not notify Modern Art Oxford accordingly, Modern Art Oxford shall have no liability for any defects and you shall be bound to pay for the goods.

Force majeure

Modern Art Oxford shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Profits

All our profits go to support the work of Modern Art Oxford.

Privacy 

Modern Art Oxford will never share any of your personal information (your address, email, phone number, etc) with any third party (meaning any person or organisation not connected to the gallery).  Your information will only be used for the purpose of processing your orders and contacting you about your orders.  If you have given us permission to contact you for other purposes, you may also receive emails about gallery news, events and information

Governing law and jurisdiction

These terms shall be governed by and construed in accordance with English Law and agree to submit to the exclusive jurisdiction of the English courts.

3D Secure

3D Secure is a payment verification protocol used by major credit card companies, branded as 'MasterCard Secure Code' and 'Verified by Visa'.
Depending on the card issuer, 3D Secure is an opt-out option or a required service for using the card to make internet purchases. Cards registered with 3D Secure could require the user to enter a Personal Identification Number (PIN) code. This is not the same PIN code issued with the card.

In basic terms, 3D Secure verifies card details, offering the country of issue and other card holder details to the proposed vendor. Depending on the information returned by the 3D Secure system, Modern Art Oxford can elect to send the goods as requested, deliver goods only to the card holder's address (instead of a nominated address) or in a very limited number of cases, we can decide to cancel an order.

Modern Art Oxford uses the 3D Secure system to prevent credit card fraud. The system is completely automated and we do not store any of the data provided by the 3D Secure system.
